Controlled Environment What controlled environment did you spend time in? How long? When I graduated from High School I entered into the Merchant Marine Academy at Fort Schuyler in New York. From then until I was in my mid thirties I was involved with ocean liners, tankers and ships. For periods of one year at a time I would be on a ship traveling the world, making shipments and patrolling the seas. The controlled environment was both on the ship and in the academy. Once on the ship I had to obey the rules and morals taught to us in the academy. Was there an effort to separate you from your former identity? No not really. Contrary to the NAVY, ARMY or Marines our boot camp was less severe and did not include such physical conditioning. Our personalities were not changed because we were not in combat and did not have to learn to be a killing machine. What were the most important rules you had to follow? Besides not falling in the water, we had to obey almost everything our captain told us. Our captain was like our parents his wishes were our commands. The captain set the standards and the rules for us to follow. What were the least and less important rules you had to follow? There was a uniform but it was not very important that we followed it. As an officer we had to look respectable but usually the uniform requirements were not met. We also had a curfew but that was rarely followed and it was rare for a person to get into any trouble for breaking curfew. What were some of the make-dos the inmates made up for their deprivations with? Since there was no T.V. almost every night after dinner we held chess and checkers tournament. The games were fast paced and mostly just for fun, no money was ever wagered. We also drank a lot of beer when we were at sea for extended amounts of time. Which were accepted by the authorities and which were not? Well the chess tournaments everyone enjoyed and were accepted by all, officers, Plebes and Captains. However drinking and other drug use was prohibited. Being caught with illegal drugs meant immediate dismissal from the corps. Being caught with alcohol meant some kind of military punishment(I never got caught). How did the inmates respond to their situation? Almost everyone on the ship enjoyed their work and being away from home. However after long periods, occasionally fights would arise and officers would end up with a black eye or broken nose. But on a whole it was usually pretty peaceful and an enjoyable environment. Do you consider your experience in the controlled environment beneficial? Absolutely, it taught me discipline and how to treat others. My experience also taught me to value what I have at home and didnt have when at sea. Do you miss the environment? When my kids are bothering me I miss the solitude of the open ocean. However, at the same time I have also had my fill of that lifestyle. Would you do it again? In a heartbeat. The person whom I interviewed is a very close family friend who entered in to the Merchant Marine Academy at the age of 18. I also interviewed another friend who was in the army and fought in Vietnam. Many of his answers coincided with those of Owen(from the merchant marines). Mikes experiences in the ARMY were a little more structured than Owens. But Mikes experience was not as enjoyable or beneficial. The benefits received from the ARMY were discipline and respect. As a sailor Owen also benefitted by seeing the world and experiencing many cultures while being in a controlled environment. Mike portrayed the ARMY to be a very structured environment, where everything that a soldier did was monitored and taken into account. The rules he had to follow were very distinct and if broken meant physical punishments (push-ups etc.). The ARMYs rules based around the constitution and defending our Nation. The Merchant Marine rules based around the safety of their officers and the good being tra nsported. Finally, contrary to Owens experiences Mikes, made an effort to separate him from his identity. Marine Herbivores An herbivore is an organism that feeds on plants. These organisms are referred to as herbivorous. An example of a marine herbivore is the manatee. The opposite of an herbivore is a carnivore or meat-eater. Origin of the Term Herbivore The word herbivorous comes from the Latin word herba (a plant) and vorare (devour, swallow), meaning plant-eating. Size Matters Many marine herbivores are small because only a few organisms are adapted well enough to eat phytoplankton, which provides the bulk of the plants in the ocean. Terrestrial herbivores tend to be larger since most of the terrestrial plants are large and can sustain a large herbivore. Two exceptions are manatees and dugongs, large marine mammals who survive primarily on aquatic plants. However, they live in relatively shallow areas, where light is not limited and plants can grow larger.   Advantages and Disadvantages of Being An Herbivore Plants such as phytoplankton are relatively abundant in ocean areas with access to sunlight, such as shallow waters, at the surface of the open ocean, and along the coast. So an advantage of being an herbivore is that food is pretty easy to find. Once it is found, it cant escape like a live animal could. On the disadvantage side, plants are more difficult to digest and more may be needed to provide adequate energy for the herbivore.    Examples of Marine Herbivores Many marine animals are omnivores or carnivores. In one of his acclaimed books, Las venas abiertas de America Latina/Open Veins of Latin America, he looks at the history of exploitation in this place from early European explorers to current United States and European endeavors. In this paper using three examples from Open Veins of Latin America by Eduardo Galeano, will show how Latin America has developed a dependency on foreign entities. Latin America was mostly untouched by the European world until 1492, when the Spanish where looking for a cheaper way to obtain the goods from the Exotic East. Galeano even goes on to speculate that even earlier explorers could have visited thus creating the religions and gods that the native tribes worshipped (pg. 17). These Spanish explorers came looking for new goods and spices, and when they saw that these natives had bits of metal upon them and inquired after them discovered that gold and silver were in abundance here. Thus began the Spanish Conquistadors reign begin in Latin America, though out numbered 10 to 1, the Spanish steadily moved out. The technology gaps between these two worlds was astounding, as Columbus earlier noted, â€Å"They knew nothing of swords, and when these were shown to them they grasped the sharp edges and cut themselves. † Along with gunpowder, full metal armor, and most importantly horses the Spanish were able to decimate and terrorize most opposing forces that they encountered. â€Å"The conquests shattered the foundations of these civilizations† (pg.43), afterwards almost every major native city and been sacked and looted along with the natives being indentured or killed. The mines that were established created the greatest displacement of the native people; it forced them into grueling labor and destroyed the agricultural communities. These early conquests helped lay the groundwork for the future exploitation of this region. Gold and silver were the main motivating forces for the Conquest, but many other goods have developed within this region. Foremost of these goods was sugar, in fact it was such suitable terrain that it proved to be a â€Å"white gold. † The early sugar plantations were pure profit for the Spanish lords, with legions of African and Native slaves and soil ideal for sugar cane. This new agriculture and overseers helped contribute to the already old agriculture downfall. Forests were felled and other crops were dismissed as unnecessary, sugar became the only crop that mattered. These plantations developed into what we know today in Latin America as the latifundio, which has been meticulously honed into a system that allows for the highest profits to the owners but hardly adequate conditions for its workers. â€Å"The latifundio as we know it has been sufficiently mechanized to multiply the labor surplus, and thus enjoys an ample reserve of cheap hands. It no longer depends on the importations of African slaves or on the encomienda of Indians; it merely needs to pay ridiculously low or in-kind wages, or to obtain labor for nothing in return for the laborer’s under of a minute piece of land. † (pg. 60) This system created was so effective at siphoning the natural resources of the region that its growth into areas can be documented by the destroyed land and displaced populace that it leaves behind. Now all these companies could obtain a bulk product for little to no cost to them, and should you happen to own the transportation for bringing the product to its destination only created more. Investors grew rich and enjoyed their success at making double profits, though workers were not so happy. Unrest has become a staple of the Latin America countries, and unfortunately it is usually painted by our governments as the opposite of what is occurring. To begin most Latin American countries are under a Dictatorship, where the military has absolute power and the only thing with more influence is the businesses that want to keep their labor cheap. Foreign entities train these dictators then give them the money and goods they require to help maintain the goals that the businesses request of them. Most unrest that is documented is the people of these regions rising up against these Dictators to install someone for the people, but it usually doesn’t last long as foreign interest is already setting up the next player for their scheme. Latin America once boasted an ancient civilization with brilliant people; astronomers, builders, leaders, but now is governed by what product is most in demand. These people have had foreign parties that have been molding the way they live and function for over 500 years. Even know as we campaign to help them we can’t begin to grasp that these people need more than foreign interests to stop exploiting them, they need it to change their whole way of life. It’s a double edged sword, for there shall always be a party that enters the system that is only focused on its own needs rather than the needs of the people. The world has so deeply ingrained itself in the history and creation of the crutch that Latin America lives off of and if we should take that crutch away, they still won’t be able to walk, but if we show them how to do it on their own and let them govern themselves and teach them. The Martian is able to make a distinction between the way that children and adults express themselves. The Martian seems to describe in an odd way about how humans keep their time trapped in a box and how we have it tied to our wrists. â€Å"But time is tied to the wrists or kept in a box, ticking with impatience. (Page 864) In this statement, it shows how he finds it hard to understand why we keep track of time in that way and because we keep it in that way, time begins to tick impatiently. In conclusion, the theme of this poem shows how everyday items can be described or viewed in such a different way from another perspective. Such things as objects, feelings, and time can be held in such a different viewpoint from two different people. Art During The Renaissance in Venice

Just as with Florence, Venice was a Republic during the Renaissance. Actually, Venice was an empire that controlled land in what is modern day Italy, a whole lot of sea coast down the Adriatic and countless islands. It enjoyed a stable political climate and thriving trade economy, both of which survived outbreaks of the Black Death and the fall of Constantinople (a major trading partner). Venice was, in fact, so prosperous and healthy that it took someone named Napoleon to undo its empire status... but, that was quite a while after the Renaissance had faded away and had nothing to do with art. An Economy Supporting Art and Artists The important part is, Venice (again, like Florence) had the economy to support art and artists, and did so in a big way. As a major port of trade, Venice was able to find ready markets for whatever decorative arts Venetian craftsmen could produce. The whole Republic was crawling with ceramists, glass workers, woodworkers, lace makers, and sculptors (in addition to painters), all of whom made entirely satisfactory livings. The state and religious communities of Venice sponsored massive amounts of building and decorating, not to mention public statuary. Many private residences (palaces, really) had to have grand facades on at least two sides since they can be seen from the water as well as land. To the present day, Venice is one of the most beautiful cities on earth because of this building campaign. Scuola (Schools) Artisan guilds—wood carvers, stone carvers, painters, etc.—helped ensure that artists and craftsmen were properly compensated. When we speak of the Venetian School of painting, its not just a handy descriptive phrase. There were actual schools (Scuola) and they were highly selective about who could (or couldnt) belong to each. Collectively, they guarded the Venetian art market zealously, to the point that one did not purchase paintings produced outside of the schools. It simply wasnt done. Venices geographic location made it less susceptible to outside influences—another factor which contributed to its unique artistic style. Something about the light in Venice, too, made a difference. This was an intangible variable, to be sure, but it had an enormous impact. For all of these reasons, during the Renaissance Venice gave birth to a distinct school of painting. The Key Characteristics of the Venetian School The main word here is light. Four hundred years prior to Impressionism, the Venetian painters were keenly interested in the relationship between light and color. All of their canvases clearly explore this interplay. Additionally, the Venetian painters had a distinct method of brushwork. Its rather smooth and makes for a velvety surface texture. It seems, too, that Venices geographic isolation allowed for a somewhat relaxed attitude toward the subject matter. A great deal of painting dealt with religious themes; there was no getting around that. Certain wealthy Venetian patrons, however, created quite a market for what we refer to as Venus scenes. The Venetian School had a brief fling with Mannerism, but mostly resisted depicting the contorted bodies and torturous emotion Mannerism is known for. Instead, Venetian Mannerism relied on vividly painted light and color to achieve its drama. Venice, more than any other location, helped make oil paint popular as a medium. The city is, as you know, constructed on a lagoon which makes for a built-in dampness factor. Venetian painters needed something durable! The Venetian School is not known for its frescoes, however. When did the Venetian School Arise? The Venetian School arose in the mid to late 15th century. Pioneers of the Venetian School were the Bellini and Vivarini (descendants of those marvelous Murano glassworkers) families. The Bellini were of particular importance, for it is they who are credited with bringing the Renaissance style to Venetian painting. The Important Artists The most important artists of the Venetian schools were the Bellini and Vivarini families, as mentioned. They got the ball rolling. Andrea Mantegna (1431–1506), from nearby Padua was also an influential member of the Venetian School during the 15th century. Giorgione (1477–1510) ushered in 16th century Venetian painting, and is rightly known as its first really big name. He inspired notable followers such as Titian, Tintoretto, Paolo Veronese,and Lorenzo Lotto. Applicability of the doctrine of financial duress and the consideration: The principle of consideration is necessary and applicable unquestionably in almost every situation in the aspect of contract law. But in modern time the essence of this doctrine reduces. Other doctrines reduce the importance of this doctrine gradually like the doctrine of economic duress, promissory estoppel, etc. The concept of financial duress is sometimes utilised to modify the application of the doctrine of consideration. The principle was used at the time when the unnecessary pressure was inserted at the time of the creation of the contract. The extortion was given importance at the time of the creation of the contract. That kind of discrepancies can lead to the bad judgements. This kind of circumstances can invalid the concept more. If one party is in the superior position that problem mainly arises. They take the advantage from the contract. Generally in this kind of situation substitute kind of consideration is required which lead to irregularity and unfairness in the judgem ent. The matter here declared about the sufficiency and adequacy in the part of the consideration. If it is proved that the benefit is a valid consideration, it is obvious that different judges posses the different opinion in this similar matter. The case of Re Select more Ltd can be taken into consideration. In this specific case, it was decided that the assurance to pay any amount was no considered to be the valid consideration under the general rule of contract. But in the case of Penny v Cole is was stated that part performance or part payment is not a sufficient consideration. In the case of Collier v P MJ Wright (Holdings) Ltddraws the relationship between the estoppel and consideration concepts. This case also proves the obsoleteness of the principle of consideration in the modern concept. On the important case of Foakes v. Beer can be discussed in this matter. This is an English contract related verdict, which is applicable the contentious pre-existing responsibility rule in the background of branch payments of the unpaid sum. It considered as the most important case from theon the legal notion ofthe principle of consideration in a contractual aspect. It recognized the regulation that stops parties from releasing a compulsion by the application of part performance. This case affirms the verdict of Pinnel's Case. In this case, the court decides that payment of smaller amount on the due day cannot be lead to any approval of the entire debt. Courts took different opinion in this matter regarding the applicability of the concept of consideration. The court provides the priority to the legally approved contract under the seal of the court. If the seal of the court is present, it provides hardly any importance to the issue of consideration. In modern aspect, it can be claimed that the tradition doctrine is obsolete or outdated. Positive and negative effects: After going through the diverse alternatives taken by the courts in this respect, now, an attempt shall be made to evaluate and understand if these options are actually attainable or not. The doctrine of duress in contract provides that if any illegal or unfair pressure is unlawfully put on any individual while he is about to enter into any contract, then, such an agreement cannot be enforced upon him. Thus, if this doctrine of duress is applied on fair and justified conditions, then, generally, it is only the weaker party that gets the protection under the legal terms. However, in a majority of the instances, it is often tough to find out and establish whether duress was actually present or not. For instance, the difference between what can be said to be a commercial pressure and what is economic duress is not yet clear post the decision of Williams v Roffey. Whatever be the situation, if it is proved that economic duress was present in any given situation, then, such a proof can override consideration and hence, the contract becomes invalid. In maximum situations, efforts are made by the courts to examine the presence of duress before they judge the validity of a contract. Albeit, no strict and stringent guidelines are present in this matter, yet, the doctrine often goes through multiple ambiguities and uncertainties. Thus, there is no doubt regarding the fact that duress will never succeed to become a replacement for the doctrine of consideration. To override the effects of consideration, the aspects of public policy also exert a great thrust. To derive the benefits, there are various public servants who can actually misuse the concepts. In such instances, although the presence of duress or extortion is likely to be very low, even then, the top-up benefits while the process remains in existence is sure to have a negative effect over the way in which the duties shall be performed. This on the face conflict is not only detrimental for the law but also for the society. Thus, to give a proper justification to the concept of duress, going through some cases is essential. Because, in the present day, our society is largely dependent on various forms of the emerging trade and commerce, hence, it is highly probable that duress will increase at a steady rate. On the contrary, this situation has not yet developed to such an extent that this entire concept can be wiped off totally by the concept of duress. The criteria of Achievability: In simple terms, it can be said that it is very tough to wipe out the concept of consideration totally and establish a way for duress. The feasibility with duress has not yet developed in such a way that it can be considered to be a total replacement of consideration. Above all, the primary role exerted by the concept of duress is totally different from the concept of consideration as far as the legal background is considered. As far as the present scenario is concerned, duress and consideration stand at an equal footing. Duress as its present status stands today is nothing but a simple exception to the doctrine of consideration because it moves in parallel lines with it. Duress is not a valid condition for examining the legality o any contract so long as the situation in today's world is concerned. In every single matter of contract, the original and traditional concept of consideration is still taken into account to establish the validity. Thus, there is no doubt regarding the fact that the doctrine of duress does not have the same effect as that exerted by the doctrine of consideration in matters related to the contract. Even if in certain circumstances, it overrides the consideration requirement, even then, holding its validity is going to be very difficult because in those circumstances, it is likely to come under the exceptions of consideration and if such a situation arises, then, consideration will be totally removed. Thus, it is very likely that these two shall become contrary to each other. Conclusion Upon understanding all the concepts as discussed above, it can be said that the doctrine of duress will not be able to override the doctrine of consideration. The consideration requirement can never be made totally redundant to give way to the requirement under duress. While looking at the changing aspects of commercial transactions, it can be said that the common law principles in this respect will develop gradually so that all the ambiguities that are present regarding the present situation can totally be removed. This will also ensure that the doctrine of duress and the doctrine of consideration will be able to meet the requirements of the law and the society and thus, the jigsaw puzzle that lies will be solved to a great extent. To give a valid jurisprudence in this regard, many more cases have to be decided by the law courts. Because it is well known that the society develops faster than the law, hence, it is essential to understand that the law is likely to go through certain f laws. To achieve a reduced rate of these flaws, there are exceptions that come out every day but those legal principles and doctrines that give a skeletal framework of the law and which is the base of the development of the law can never be overlooked, and they should be allowed to keep running. The reason behind this is that they exercise impact over many operations in which the society is engaged. A similar effect lies over the doctrine of consideration also. If the entire concept is abolished, there will be greater confusions, and hence it is not going to be a wise decision for the legal domain.
